ХУУЛЬ ЁСООР ӨВЛӨХ ЭРХИЙН ЗАРИМ АСУУДАЛ

Abstract

 If we look at how the rights of
inheritance has been reflected in the Constitu-
tion of Mongolia we will clearly see that it has
been only generally defined; as it is stated that
“Mongolian citizens will be assured the rights
of inheritance”. The rights of inheritance as a
key component of civil law are also systemized
to be a part of property rights. The legislation
on property rights includes the rights to fair
acquisition, possession, use and inheritance of
property to others. This article is aimed at the
identifying the unique features of inheritance
rights as belonging to civil law and improving
the legal basis for regulating the rights of in-
heritance.
