THE PROBLEM OF RETROACTIVITY IN AMENDING STATUTES OF LIMITATION - A GERMAN PERSPECTIVE
Abstract
When the legislature amends the rules governing the statute of limitations for
criminal offenses, the question inevitably arises as to which offenses are affected by these
amendments. Undoubtedly, the new statutes of limitation apply to those acts that are
committed after the amendments have come into force. But what about acts committed
before that time? Should the new statutes of limitations also apply retroactively to these
acts?
