KEY ISSUES OF THE LEGAL REGULATION OF THE CRIMINAL LIMITATION OF THE RIGHT TO TRAVEL

In criminal law, the issue of imposing criminal liability, including the rational application of punishment, is an extremely important issue. Only when punishment is appropriate and inevitable for the criminal act, the basic conditions for establishing justice in society are created.
The effectiveness of punishment is contained in its inevitable and appropriate form. The researcher believes that the new legalization of “punishment for restricting the right to travel” in the revised version of the Criminal Code, within the framework of legal reforms carried out in recent years, has become a progressive regulation.
This article aims to present conclusions and proposals in the direction of clarifying the effectiveness of the right to travel and the criminal process to be followed in the event of a person sentenced to a travel sentence fleeing.
